HB 251 Summary

• Amends AS 28.10.391(a) to clarify that liens for labor, material, transportation, storage, or similar activities are subordinate only to mortgages and conditional sale contracts that are properly filed before the vehicle comes into the lienholder's possession.

• Modifies AS 28.10.502(b) to require notification of vehicle towing, transporting, or storage be sent by certified letter with return receipt requested within seven working days after initial towing or storage.

• Specifies that storage charges cease to be part of a possessory lien after 60 days unless the registered owner or primary lienholder receives actual notice or the certified letter is mailed within the required timeframe.

• Limits liens under AS 28.10.502 to towing, storage charges, and associated mailing fees.

• Takes effect immediately upon enactment under AS 01.10.070(c).
