Identification cards expire on the cardholder's birthday in the fifth year after issuance; cards issued to persons 60 years or older expire in the tenth year and are issued at no cost.

Department of Motor Vehicles may issue identification cards to persons with valid nonimmigrant visa status, pending asylum applications, refugee status, temporary protected status, approved deferred action, or pending adjustment of status applications, with cards expiring based on authorized stay period.

Driver's license applicants must present valid documentary evidence of U.S. citizenship, national status, legal permanent residency, or conditional resident alien status; alternatively, they may present evidence of nonimmigrant visa status or other qualifying immigration statuses listed in the bill.

Persons renewing, duplicating, or changing names on existing licenses are presumed to meet citizenship requirements if the license expired less than 90 days ago and has not been cancelled, suspended, or revoked, unless the department has been notified by a government agency that the person is not a citizen or legally present.

The state may not adopt regulations solely to comply with the Federal REAL ID Act of 2005, and this Act is not construed as support for or cooperation with that federal law; effective date is January 1, 2011.
