Establishes a new fee schedule for workers' compensation medical services effective December 31, 2010, based on statistically credible data from American Medical Association and Health Care Procedure Coding System at the 90th percentile and reflecting geographical cost differences.

Prior to December 31, 2010, caps medical service fees at the board's December 1, 2004 schedule adjusted by Consumer Price Index changes (2004-2006 adjustment for services through March 31, 2009; 2004-2008 adjustment for services March 31, 2009 through December 31, 2010).

Removes civil liability and theft by deception charges for fraudulent workers' compensation claims, allowing prosecution only under general criminal law.

Establishes civil liability for workers' compensation violations, permitting recovery of compensatory damages plus treble damages (three times the compensatory amount), subject to statutory adjustment, plus reasonable attorney fees.

Takes effect immediately upon enactment.
