HB 366 Summary

• Adds AS 45.45.905 to prohibit motor carriers and shipping persons from entering indemnification agreements that would protect either party from claims or liability arising from their own negligence, intentional acts, or intentional omissions.

• Declares any agreement violating the prohibition void and unenforceable as against public policy.

• Exempts the Uniform Intermodal Interchange and Facilities Access Agreement administered by the Intermodal Association of North America and other intermodal equipment agreements from the indemnification prohibition.

• Defines "motor carrier" as a person transporting property for compensation by motor vehicle with a gross weight rating greater than 10,000 pounds, and "shipping person" as one contracting for such transportation services, including their respective agents and contractors.

• Applies only to agreements entered into on or after the effective date of the Act.
