HB 37 Summary

• Establishes state policy that the right to work cannot be infringed based on labor organization membership, affiliation, or financial support, or refusal to join.

• Prohibits employers from requiring employees to join labor organizations, pay dues, or be referred through unions as conditions of employment.

• Allows employers to deduct union dues only with signed, written authorization that employees may revoke at any time.

• Makes union shop and agency shop agreements void and establishes class B misdemeanor penalties for violations, with employees entitled to injunctive relief and damages.

• Extends protections to public employers and employees under the Public Employment Relations Act; takes effect immediately and applies to collective bargaining agreements entered into on or after the effective date.
