CSHB 71(JUD) - Advance Health Care Directives Registry

• Department of Health shall establish and maintain a statewide registry containing names of individuals who have filed advance health care directives and scanned copies of those directives.

• Individuals may voluntarily file their written advance health care directives with the registry, and the department must remove directives upon written request.

• Health care facilities and hospitals are protected from civil or criminal liability for acting on directives obtained from the registry or for failing to check the registry.

• Registry information is confidential and accessible only to the directive maker, their agent/guardian/surrogate, and Alaska health care facilities treating the patient; the department may charge fees not to exceed administrative costs, except no fees for removals or facility inquiries.

• Department must make the registry available online 24 hours daily to Alaska hospitals, establish security procedures by regulation, and is not liable for civil damages related to registry administration.
