School districts, principals, and teachers may not administer questionnaires or surveys inquiring into personal or private family affairs of students without written permission from the student's parent or legal guardian, except as provided for the Youth Risk Behavior Survey.

School districts must provide written notice to parents or guardians at least two weeks before administering a questionnaire or survey that includes the administration date, content description, survey sponsor, contact person, and how to review the survey.

Written notice must include descriptions of how the survey will be administered, how parents can submit permission or denial, and notice that students may refuse to answer specific questions or refuse to participate entirely.

Students may refuse to answer specific questions on a questionnaire or survey, and parents or guardians may refuse to allow student participation by submitting written denial to the teacher or school principal.

The Youth Risk Behavior Survey from the Centers for Disease Control and Prevention does not require written parental permission but requires notice at least two weeks in advance and the opportunity for parents to submit written denial of participation.
