SB 126 Summary

• Places the state comptroller in the Department of Revenue in the exempt service under the State Personnel Act.

• Requires retired teachers hired by school districts to have been separated from employment for at least 90 days and permits districts to adopt policies allowing their reemployment to address teacher shortages.

• Requires two sequential recruitment periods (at least 15 days each, totaling at least 30 days) that each result in fewer than three qualified applicants before a school district or political subdivision may hire a retired employee.

• Changes the separation requirement for retired public employees from 30 days to 90 days before reemployment by political subdivisions and public organizations.

• Extends the effective date of sections 3, 5, 9, and 12 of chapter 57, SLA 2001 and section 3 of chapter 50, SLA 2005 from July 1, 2009 to July 1, 2010, with conditional retroactivity if enacted after July 1, 2009.
