Creates a statewide electronic health information exchange system administered by the Department of Health and Social Services to improve healthcare quality, reduce medical errors, and increase care efficiency.

Requires the commissioner to designate a qualified entity or entities to establish infrastructure planning and implementation measures, with an advisory board including representatives from hospitals, providers, insurers, tribal health organizations, consumers, and employers.

Establishes security standards to protect patient health information confidentiality, including access controls, electronic audit systems, and compliance with the most stringent applicable federal or state privacy laws.

Prohibits release or publication of individually identifiable health information for purposes unrelated to treatment or billing, and strictly prohibits marketing use of patient data.

Requires annual reports to the legislature on system progress and recommendations for long-term state participation and financial support; effective date July 1, 2009.
