SB 153 Summary

• Establishes a clear statutory procedure for converting manufactured homes affixed to real property into real property and for severing them from real property.

• Creates a manufactured home becomes real property when it is permanently affixed to land, an affixation affidavit is recorded, ownership interests are identical, and the manufacturer's certificate of origin or certificate of title is cancelled or conversion is confirmed with the Department of Administration.

• Requires owners to file applications with the Department of Administration to cancel manufacturer's certificates of origin or certificates of title, or to confirm conversion of affixed manufactured homes to real property.

• Establishes procedures for severing manufactured homes from real property through recording of severance affidavits and allows issuance of new certificates of title for severed homes.

• Takes effect January 1, 2010, with regulations to be adopted by the Department of Administration by that date.
