Requires written informed consent before any person can retain, analyze, disclose, or distribute biometric information on an individual, with the right to revoke or amend consent at any time.

Prohibits requiring biometric data for identification if an individual provides a valid current U.S. passport and state or armed forces identification card.

Establishes civil liability for violations with actual damages plus a $5,000 penalty, or $100,000 if the violation resulted in profit or monetary gain.

Exempts law enforcement biometric use for identification of perpetrators, crime investigation, and identification of missing or unidentified persons, as well as uses authorized by state or federal law.

Defines biometric data as fingerprints, handprints, voices, facial images, iris images, or retinal images, and establishes a uniform consent form process administered by the Department of Health and Social Services.
