SB 222 Summary

• Restricts sex offender probation violation crimes to violations of specific probation conditions, removing parole violations from the statute and making violation a class A misdemeanor.

• Expands child pornography possession statute to include knowing access to depictions on a computer with intent to view, and adds affirmative defense for possession of fewer than three depictions if person destroys them or reports to law enforcement.

• Broadens distribution of indecent material to minors statute to cover all distribution methods (not just electronic) and establishes class B felony penalty if offender was previously required to register as sex offender.

• Eliminates suspension of sentence option for convictions of sex offenses (AS 11.61.125 - 11.61.128) and certain other violent crimes, and adds aggravating sentencing factors for offenses against dating partners or when offender is 10+ years older than victim.

• Grants attorney general power to issue administrative subpoenas requiring Internet service providers to disclose account holder information in investigations of child exploitation offenses (AS 11.41.452, 11.41.455, 11.61.125 - 11.61.128).
