SB 243 Summary

• Transfers authority over geothermal well permitting and inspection from the Department of Natural Resources to the Alaska Oil and Gas Conservation Commission effective July 1, 2010.

• Reduces geothermal resource royalty rates to 1.75 percent of gross revenues for the first 10 years of production and 3.5 percent thereafter, replacing the previous 10-15 percent range.

• Establishes an annual regulatory cost charge for geothermal well operators, determined by the Commission based on each operator's share of total well volume to recover the Commission's operating costs.

• Authorizes the Commission to issue well-spacing and pooling orders, impose production limits, and require reinjection to prevent waste and protect correlative rights in geothermal systems.

• Defines geothermal resources and related terms, including requirements for drilling permits and surety bonds to ensure operator compliance with safety and environmental regulations.
