SB 295 Summary

• Prohibits manufacturing, selling, or distributing products containing more than 0.1 percent by mass of pentaBDE, octaBDE, or decaBDE flame retardants.

• Applies restrictions to mattresses, mattress pads, upholstered furniture with textile components, and electronic products with plastic housings containing prohibited flame retardants.

• Exempts transportation vehicles, industrial equipment, electronic wiring used for power transmission, used items, and products brought into the state before the effective date.

• Requires the Department of Environmental Conservation to establish and update a list of persistent bioaccumulative toxic chemicals every three years and may prohibit non-brominated flame retardants by regulation if safer alternatives exist.

• Establishes civil penalties of up to $1,000 per violation and requires manufacturers to notify retailers of prohibitions; takes effect January 1, 2011.
