Changes the standard for establishing survivorship community property by requiring both spouses to explicitly agree in writing to include survivorship rights, rather than making it automatic when certain language is used.

Allows spouses to create community property through written community property agreements or by transferring property to a community property trust with an express declaration, regardless of how the title is held.

Specifies that upon a spouse's death, ownership rights in survivorship community property pass solely to the surviving spouse by nontestamentary disposition, and the deceased spouse has no right to dispose of such property at death.

Requires both spouses to agree in writing to any beneficiary designation on community property created through community property agreements or trusts in order for the designation to be valid.

Clarifies that merely holding property in certain title forms does not automatically establish survivorship ownership between spouses without their explicit written agreement.
