HB 134 - Right To Work

• Establishes state policy protecting individual freedom of choice in employment by prohibiting mandatory membership, affiliation, or financial support of labor organizations as a condition of employment.

• Prohibits collective bargaining agreements from requiring employees to join unions, pay union dues, or pay equivalent amounts to charities, and mandates employer deductions require signed written employee authorization that can be revoked.

• Declares void any agreements between labor organizations and employers that violate employee rights, and prohibits strikes, boycotts, or coercion to force compliance with union membership requirements.

• Establishes criminal penalties of class B misdemeanor for knowing violations and allows injured employees to seek injunctive relief, damages, and attorney fees through civil action; directs attorney general to investigate and prosecute violations.

• Applies protections to public employers and public employees under the Public Employment Relations Act and takes effect immediately for agreements entered into on or after the effective date.
