HB 258 - Naturally Occurring Asbestos

• Directs the Department of Transportation and Public Facilities to develop standards, operating procedures, and site-specific use plans for gravel or aggregate material containing naturally occurring asbestos in designated project areas.

• Grants immunity from civil asbestos-related claims to the state, landowners, extractors, suppliers, transporters, and contractors when using such materials in compliance with department requirements and where asbestos content equals or exceeds 0.25 percent by mass.

• Requires contractors to submit site-specific use plans describing containment, sealing, or mitigation measures to prevent asbestos fibers from becoming airborne, and to record project completion notices in property records documenting asbestos presence.

• Allows temporary interim designations of limited project areas and approval of construction projects until full standards under AS 44.42.420 are implemented, with authority expiring December 31, 2013.

• Establishes California Air Resources Board Method 435 as the interim bulk testing standard to determine asbestos content in aggregate material.
