HB 301 Summary

• Amends AS 05.25.080 to clarify that the Department of Public Safety has enforcement authority over boating safety statutes and that no state department may cede waterway management authority to the federal government.

• Exempts federal employees from enforcing Alaska's boating laws; allows state peace officers and authorized Department of Natural Resources personnel to enforce boating regulations and board watercraft with probable cause.

• Amends Section 30 of Chapter 28, SLA 2000 to change the effective date of boating safety statutes (sections 3, 5, 7, 9, 11, 14, 16, 18, 20, 23, 26, and 27) to the earlier of July 1, 2013, or 90 days after the Alaska Legislative Council notifies the revisor that the state did not receive federal funding for a statewide boating and safety education program.

• Requires the director of legislative finance to notify the Alaska Legislative Council when the state does not receive federal boating safety funding, with any such notice requiring majority approval of the council.

• Takes effect immediately upon enactment, except provisions in Section 2 take effect under the same conditional date as other boating safety statutes.
