• Commissioner may not deny aquatic farm permits for geoduck cultivation based solely on the absence of wild geoduck stock within a management area.

• If a permit is issued for geoduck farming in an area without existing wild geoduck stocks, operations are prohibited in intertidal habitat or environment.

• Certified hatcheries may transfer geoduck seed to aquatic farms located in fisheries management areas that are contiguous to the Gulf of Alaska, subject to existing hatchery certification requirements.
