HB 7 Summary

• Classifies 10 synthetic cannabinoid compounds as schedule IIIA controlled substances, including JWH-018, JWH-073, HU-210, and others commonly found in herbal products and tobacco applications.

• Establishes possession penalties for schedule IIIA substances sprayed on tobacco or organic materials: 12 grams or more constitutes fourth-degree misconduct, while 6 grams or less constitutes sixth-degree misconduct.

• Modifies fourth-degree misconduct penalties to include possession of 25 or more tablets or ampules of schedule IIIA controlled substances and increases threshold for schedule VIA substances to 4 ounces aggregate weight.

• Updates fifth and sixth-degree misconduct statutes to reflect new possession thresholds and penalties for synthetic cannabinoid compounds and their various forms.

• Takes effect July 1, 2011.
