HB 87 Summary: Antitrust Violation Penalties

• Changes criminal penalty for violations of AS 45.50.562 and AS 45.50.564 from misdemeanor to class C felony.

• Increases criminal fines for natural persons from $20,000 to $1,000,000 and for non-natural persons from $50,000 to $50,000,000.

• Removes prior imprisonment limitation of one year, allowing imprisonment as provided in AS 12.55.

• Adds new civil penalty authority allowing the attorney general to bring civil actions against persons who violate AS 45.50.562, 45.50.564, 45.50.568, or 45.50.570, or violate injunctions under AS 45.50.580.

• Establishes civil penalty caps of $1,000,000 for natural persons and $50,000,000 for non-natural persons.
