CS FOR SENATE BILL NO. 180(JUD) - Summary

• Directs Department of Transportation and Public Facilities to develop standards, operating procedures, and designate project areas for use of gravel containing naturally occurring asbestos (NOA) at 0.25 percent by mass or greater.

• Grants civil immunity from asbestos-related damage claims to landowners, extractors, suppliers, transporters, and contractors using or handling NOA-containing gravel in designated areas when complying with approved site-specific use plans.

• Requires contractors to submit site-specific use plans demonstrating compliance with state standards, including plans to contain, seal, or prevent asbestos fibers from becoming airborne or transferring outside project areas.

• Mandates that within 60 days of project completion, responsible parties record a notice in the property recording district indicating the presence of naturally occurring asbestos and potential legal obligations for subsequent property holders.

• Establishes interim authorization for limited construction projects until December 31, 2013, using California Air Resources Board Method 435 as the temporary standard for bulk testing of asbestos content.
