SB 72 Summary

• Expands stalking definition to include GPS tracking, surveillance devices, and software; defines "device" to include software.

• Increases online enticement of a minor from class C to class B felony, and to class A felony if offender is required to register as sex offender or child kidnapper.

• Creates new crime of "sending an explicit image of a minor" (class B misdemeanor for 1-2 recipients, class A misdemeanor for 3+ recipients, class C felony if distributed on Internet); exempts minors distributing their own images.

• Creates two new crimes for misconduct involving confidential information: first degree (class A misdemeanor) and second degree (class B misdemeanor) when obtained without legal authority.

• Allows prosecution of crimes involving minors committed outside Alaska if the victim or person communicated with was in-state; establishes mandatory probation supervision for felony offenses and authorizes it for misdemeanors; effective July 1, 2011.
