SB 86 Summary

• Expands reporting requirements for professionals to include harm to vulnerable adults, defined as persons 18+ unable to meet their own needs due to incapacity, mental illness, physical disability, advanced age, fraud, or other conditions

• Creates new ex parte and temporary protective orders under AS 13.26.207-13.26.209 to protect vulnerable adults' assets from financial exploitation, with no filing fees and expedited court hearings (20-72 hours)

• Establishes temporary conservatorships during pending conservatorship proceedings to protect vulnerable adults from waste or dissipation of funds or property

• Makes violating protective orders for vulnerable persons a crime under AS 11.56.740 and adds victim age (65+) as an aggravating sentencing factor for certain offenses

• Defines "fraud," "undue influence," "exploitation," "deception," and "fiduciary duty" in vulnerable adult protection statutes; expands investigation powers for adult protective services and requires investigator training
