HB 9 Summary

• Amends Alaska's Uniform Commercial Code (AS 45.29) to update secured transaction rules, including definitions of "authenticate," "certificate of title," "registered organization," and "public organic record"

• Modifies rules for electronic chattel paper control, collateral location determination for federally-regulated organizations, and financing statement requirements for debtors including individuals, trusts, and decedents' estates

• Updates AS 45.14.108 to clarify that remittance transfers under federal law are governed by both state UCC provisions and the federal Electronic Fund Transfer Act (15 U.S.C. 1693-1693r), with federal law controlling in case of conflict

• Establishes transition rules for security interests perfected before July 1, 2013, allowing up to one year for compliance with new perfection requirements under the amended code

• Requires the Department of Natural Resources to adopt regulations implementing these changes and to provide UCC financing statement forms identical to those adopted by the American Law Institute and National Conference of Commissioners on Uniform State Laws; effective July 1, 2013
