HB 121 Summary: Alaska Code of Military Justice

• Establishes comprehensive military justice code (AS 26.05.400-26.05.999) governing courts-martial, military offenses, and procedures for Alaska militia members in active state service

• Creates three types of courts-martial (general, special, and summary) with specified jurisdiction, membership requirements, and procedural rules modeled after federal Uniform Code of Military Justice

• Grants Alaska Court of Appeals jurisdiction to hear appeals of convictions and sentences from general and special courts-martial involving confinement

• Defines military offenses (desertion, insubordination, fraud, etc.) and establishes nonjudicial punishment authority for commanding officers to impose disciplinary actions for minor offenses

• Includes provisions for involuntary commitment of accused persons found incompetent to stand trial and protections for accused rights including legal representation, investigation procedures, and mental health evaluations
