Sellers, retailers, and vendors must verify a customer is at least 18 years old via government-issued photo identification or reasonably presume from appearance they are 25 or older before selling products containing dextromethorphan.

Persons under 18 years of age may purchase dextromethorphan products with a valid prescription issued by a licensed practitioner.

Knowing or willful violations result in a fine of $150 for the first violation and $250 for each subsequent violation.

Authority to regulate dextromethorphan is reserved to the state, and municipalities are prohibited from enacting or enforcing ordinances regulating the possession or sale of dextromethorphan except as specifically provided by statute.

The act takes effect May 1, 2016.
