Legislature finds the EPA's proposed Clean Power Plan violates the Tenth Amendment and directs the governor, attorney general, and Department of Environmental Conservation to defend state sovereignty and seek exemption from the rule.

Department of Environmental Conservation shall develop a state plan to comply with federal Clean Air Act section 111(d) only after the EPA finalizes the Clean Power Plan rule.

Department must prepare a report assessing the plan's effects on electric power sector reliability, electricity prices, consumer impacts, employment, economic development, government tax revenue, and required state law changes.

Department shall deliver the state plan and report to the legislature at least 15 days before completion and cannot submit the plan to EPA without legislative approval.

If the legislature rejects the state plan, the department may submit a revised plan with an accompanying revised report for reconsideration.
