HB 270 Summary

• Establishes criminal history check requirements under AS 47.05.310 prohibiting individuals charged with, convicted of, or adjudicated for crimes inconsistent with licensure standards from owning or working at Department of Health and Social Services licensed entities.

• Creates new civil history check requirements under AS 47.05.325 prohibiting individuals who are subjects of child-in-need-of-aid petitions or have substantiated findings of abuse/neglect from owning or working at DHSS licensed entities.

• Requires fingerprint submission and criminal justice information reports for individuals applying for ownership, employment, or regular contact positions at licensed entities, with fees established under AS 12.62.160.

• Establishes centralized registry under AS 47.05.330 to identify individuals with substantiated abuse/neglect findings, Medicaid sanctions, revoked/suspended licenses, or similar findings in other jurisdictions; registry is confidential and not subject to public inspection.

• Applies restrictions to unlicensed entities and individual service providers receiving DHSS payments by making them ineligible for payment if in violation of criminal or civil history requirements.

• Takes effect immediately upon passage.
