HB 274 Summary

• Allows state land leases to be extended once for up to two years if the director determines extension is necessary while considering lessee preference applications, lease renewal applications, or new lease applications that substantially change lease purpose or operation.

• Lease extensions are exempt from the finding and determination requirements under AS 38.05.035(e), but the director must provide public notice of the extension decision.

• Authorizes the director to exchange state land (including land estate, mineral estate, or both) for land, interest in land, or other consideration when in the state's best interest and subject to notice requirements under AS 38.05.945.

• Permits exchanges where property is not of approximately equal value if the director finds that property received plus other public benefits equals or exceeds property relinquished by the state; requires legislative review for exchanges exceeding $5,000,000 or lacking approximately equal value.

• Requires at least two public meetings for exchanges over $5,000,000, with at least one in-person meeting in a municipality close to the affected state land; clarifies that "state land" includes shoreland, tideland, and submerged land.
