Department temporarily suspends all medical assistance payments to a provider upon commissioner determination of credible fraud allegation or notice of charges, without prior notification to the provider.

Department must provide notice within 5 days (unless attorney general requests temporary hold of less than 30 days) or 30 days (if attorney general requests), with maximum delay not exceeding 90 days.

Notice must include statement of suspension, general allegations description, explanation that suspension is temporary, affected claim types, and information about appeals process under AS 44.64.

Department must refer credible fraud allegations to attorney general or law enforcement within next business day and discontinue suspension if insufficient evidence found or legal proceedings completed.

Department must conduct quarterly reviews of suspensions and may decline suspension or impose partial suspension upon finding good cause, including when law enforcement requests it, sole provider concerns exist, or other remedies better protect funds.
