CS FOR HOUSE BILL NO. 334(HSS) - Summary

• Removes reference to a presumption in AS 25.24.150(g) from custody determination factors in AS 25.20.060(a), AS 25.20.070, and AS 25.20.095(g).

• Changes the standard for domestic violence conditions on visitation from "committed a crime involving domestic violence" to "has a history of perpetrating domestic violence or been convicted of a crime involving domestic violence" within five years preceding visitation award.

• Expands the definition of protected persons to include domestic living partners in addition to other parents and children when considering domestic violence conditions on visitation.

• Adds new subsections (m) and (n) to AS 25.24.150 allowing courts to set visitation conditions for parents with domestic violence history and establishing procedures for custody determinations when both parents have committed domestic violence crimes.

• Repeals AS 25.24.150(g), (h), (i), and (j) and applies the changes only to visitation and custody orders issued on or after the effective date.
