CSHB 38(RES) - Aquatic Invasive Species Response

• Authorizes the Department of Fish and Game to use chemical, biological, mechanical, or physical methods to control or eradicate aquatic invasive species consistent with state and federal law.

• Allows the department to apply for suspension of or exemptions to environmental laws and regulations when responding to aquatic invasive species.

• Prioritizes aquatic invasive species response and management over other regulated department activities, and permits the commissioner to summarily open or close seasons or areas to aid response efforts.

• Requires all state departments and agencies to cooperate with response efforts, and requires the department to provide reasonable notice to affected property owners and minimize harm to native fish populations and private property when responding.

• Establishes the aquatic invasive species response fund within the general fund to pay for control and eradication efforts, with appropriated money available for spending without further appropriation and non-lapsing authority.
