HB 96 - Biometric Information

• Requires collectors to notify individuals in clear terms before collecting biometric data for use in a biometric system, including the specific purpose and retention duration, and obtain written or documented consent.

• Prohibits disclosure, transfer, or distribution of biometric information except to contractors or persons authenticating identity, and only for the original stated purpose.

• Prohibits sale of biometric information, except contractors may sell their business and transfer the data to the buyer.

• Requires collectors and contractors to securely store biometric information and destroy it within 120 days after the original purpose no longer applies, with notification to contractors required within 60 days.

• Allows individuals to revoke or amend consent after the original purpose ceases, and establishes civil liability of $1,000 per violation ($5,000 if violation resulted in profit or gain).

• Exempts law enforcement purposes, information authorized by state or federal law, Department of Administration facial images for driver's licenses and ID cards, and photographs not collected for biometric systems.
