SB 10 Summary

• Prohibits refiners, distributors, and retailers from selling or offering to sell aircraft fuel, motor vehicle fuel, heating fuel, and diesel fuel at unconscionable prices in Alaska.

• Applies to refiners with annual sales exceeding 1,000,000 gallons and defines distributors as entities selling to retailers and retailers as those selling at retail.

• Authorizes the attorney general to investigate violations and recover civil penalties of at least 10 times the economic benefit obtained through unconscionable pricing, in addition to standard civil penalties.

• Restricts private civil actions by prohibiting consumers from bringing individual lawsuits for damages or injunctions; only the attorney general may enforce the statute.

• Allows defendants to present evidence that alleged unconscionable prices were attributable to additional reasonable costs incurred in connection with the fuel sale.
