SB 110 Summary

• Establishes comprehensive code of military justice for Alaska militia members in active state service, modeled on federal Uniform Code of Military Justice (10 U.S.C. 801-946)

• Creates three types of courts-martial (general, special, summary) with defined jurisdictions and procedures for trying military offenses, with maximum sentence of 10 years confinement

• Establishes Military Appeals Commission (three appointed members) to hear appeals from court-martial sentences, with further appellate review available to state court of appeals

• Provides procedural protections including rights to counsel, investigation before trial, protection against self-incrimination, statute of limitations (three years), and mental competency evaluation provisions

• Effective July 1, 2016; applies to offenses occurring on or after that date; repeals prior military code sections (AS 26.05.300, .310, .320, .322, .324, .326, .330, .350)
