Legislators become ineligible for salary after the first 90 consecutive days of a regular legislative session if the legislature has not passed a bill that fully funds an operating budget.

Legislators lose their daily per diem allowance after 90 consecutive days of a regular session if an operating budget bill has not been passed by the legislature.

Salary and per diem eligibility remain suspended until either a bill fully funding an operating budget is passed or the next regular legislative session begins, whichever occurs first.

The Alaska Legislative Council must adopt a policy that applies per diem and moving expense reimbursement equally to all legislators in accordance with the 90-day budget requirement.

The Employees' Compensation Commission report on legislative compensation becomes subject to the 90-day operating budget requirement before recommendations take effect.
