Law enforcement agencies must obtain a search warrant before accessing information on electronic devices, with limited exceptions.

Warrantless searches are permitted only when the device owner reports it stolen, information is needed for emergency services, the owner/primary user consents, or under judicially recognized warrant exceptions.

Evidence obtained from warrantless electronic device searches is inadmissible in civil, criminal, administrative, or other proceedings and cannot be used to establish probable cause for obtaining a warrant.

"Electronic device" includes any device enabling access to electronic communication services, remote computing services, or location information services.
