SB 45 Summary

• Amends AS 29.35.450(c) to add an exception allowing changes to parks and recreation service area boundaries to include subdivisions or parcels that are wholly or partially within the exterior boundaries of the service area without requiring voter approval.

• Maintains existing voter approval requirements for abolishment, expansion, alteration, or consolidation of road, fire protection, and parks and recreation service areas.

• Provides exceptions to voter approval requirements for fire protection service areas that increase parcels by no more than 6 percent and add no more than 1,000 residents.

• Allows road service area abolishment or consolidation in second class boroughs without voter approval if the service area has not levied taxes in 12 months, the board has not met with a quorum, or road maintenance contracts fail to meet minimum standards.

• Exempts subdivisions or parcels from voter approval when added to road service areas if roads maintained by the service area provide the only access or required access by subdivision plat.
