SB57 Summary

• Requires the state department to seek a waiver or exemption from federal Clean Air Act Section 111(d) requirements before developing a state emission standards plan.

• Prohibits submission of any state plan to the EPA until the department determines it will not increase retail electric rates disproportionately on low or moderate income households, reduce electric service reliability, impair existing generation investments, harm manufacturers or other economic sectors, decrease employment, or reduce state/local revenue.

• Mandates the department prepare a public report assessing the plan's effects on electric power sector affordability and capacity, consumer electricity costs, state employment, economic development, government revenues, and state law requirements.

• Requires the department to deliver the state plan and assessment report to the legislature at least 15 days before EPA submission.

• Takes effect May 15, 2015.
