Department of Health and Social Services may require Medicaid recipients to purchase used or refurbished durable medical equipment instead of new equipment when authorized to provide such items.

Used or refurbished equipment may be required only if it is available, less expensive than new equipment of the same type, able to withstand at least three years of use, and meets the recipient's needs.

Adds definition of "durable medical equipment" as equipment that can withstand repeated use, is primarily used for medical purposes, is not useful without an illness or injury, and is appropriate for use in the home, school, or community.

Effective date is immediate upon enactment.
