CSHB 255 - Certificate of Fitness Requirements

• Individuals must obtain a certificate of fitness before performing electrical wiring work subject to AS 18.60.580 or plumbing work subject to the uniform plumbing code.

• Employers may not use employees to perform electrical or plumbing work unless the employee holds a valid certificate of fitness, with an exemption for employees of electric utilities serving areas with no municipality exceeding 2,500 population.

• Violations are classified as civil violations with maximum fines of $500, enforced through a citation system managed by the Department of Labor and Workforce Development.

• Civil penalties are imposed separately from citations: individuals violating certificate requirements face up to $125 for first violation and $250 for subsequent violations; employers face up to $250 for first violation and $500 for subsequent violations.

• Persons issued civil penalty notices may request a hearing within 30 days, with hearings scheduled before a hearing officer and final decisions subject to superior court review under the Administrative Procedure Act.
