HB 26 Summary

• Requires employers to provide reasonable unpaid break time for nursing mothers to breastfeed or express breast milk during the work day.

• Break times must occur at intervals that reasonably ensure the mother's and child's health and comfort and allow the employee to maintain breast milk supply.

• Mandates employers provide a private and sanitary space located near the employee's work area for breastfeeding or expressing milk, with the restriction that this space cannot be a toilet stall.

• Allows break time to run concurrently with other breaks already provided to the employee.

• Defines "employer" as any person that has one or more employees and does not require employers to allow children in the workplace outside of designated break times.
