HB 271 Summary

• Prohibits smoking in enclosed areas in public places including entertainment venues, public transportation, retail stores, restaurants, bars, offices, hotels, and educational and health care facilities, effective October 1, 2018.

• Prohibits smoking outdoors within 10 feet of playground equipment while children are present, within 20 feet of building entrances or ventilation intakes, and in outdoor seating areas of arenas and stadiums.

• Allows municipalities to exempt themselves from smoking prohibitions through voter-approved ordinances, and permits established villages with 25+ residents to adopt local options allowing smoking through a special election process.

• Sets civil fines of $50 for individual smoking violations and $50-$300 for employer or building manager violations that fail to enforce the prohibition or provide smoking accessories.

• Requires the Department of Health and Social Services to develop education programs, maintain violation reporting procedures, and administer enforcement through citations and civil complaints.
