HB 340 Summary

• Repeals the Alaska BIDCO Assistance program and all associated statutes (AS 37.17.500-37.17.690) that established loans and financial assistance for Business and Industrial Development Corporations.

• Removes the requirement for the Department of Commerce, Community, and Economic Development to conduct annual examinations of BIDCOs and eliminates the authority to adopt regulations under the former BIDCO program statutes.

• Transfers the Alaska BIDCO fund to the general fund, subject to appropriation, and redirects future principal, interest, and fees from BIDCO borrowers to the general fund.

• Modifies BIDCO minimum net worth requirements by removing the $500,000 alternative threshold that was available to BIDCOs receiving loans under the assistance program, establishing a uniform $1,500,000 minimum net worth.

• Allows existing BIDCO loans and financial assistance agreements made before the effective date to continue under the former statutes until those statutes no longer apply by their own terms, preserving existing contracts and obligations.
