State agencies cannot adopt new regulations unless they meet one of six conditions: initial regulations for newly created boards/commissions, repeal of existing regulations with equal or lesser cost, emergency regulations, implementation of laws enacted within 120 days, net cost estimates of zero or less, or lieutenant governor determination that regulation is narrowly tailored and necessary.

State agencies cannot submit amended regulation sets unless the estimated net cost is zero or less, or the Department of Commerce, Community, and Economic Development adopts the regulation to amend an occupation-related fee under Alaska Statutes 08.

Alaska Oil and Gas Conservation Commission and Regulatory Commission of Alaska are exempt from requirements for amended regulation sets.

Lieutenant governor may not accept regulations that do not comply with these requirements and may extend timelines for adopting regulations implementing new or amended laws for reasonable cause.

Effective date is January 1, 2018, and applies to regulations adopted on or after that date.
