Agencies with access to federal tax information must develop written policies establishing background investigation procedures and criteria for determining employee qualifications, with reinvestigations required no later than 10 years after the previous investigation.

All background investigations and criminal history record checks are confidential, with information used only to determine qualifications to access federal tax information; agencies may share investigations with employee written consent if the employee applies to another agency with similar access requirements.
