SB 16 - Revised Uniform Fiduciary Access to Digital Assets Act

• Adopts the Revised Uniform Fiduciary Access to Digital Assets Act by adding Chapter 63 to AS 13, establishing procedures for fiduciaries and designated recipients to access digital assets of deceased individuals, incapacitated persons, and principals.

• Users can direct custodians via online tools to disclose or restrict access to their digital assets, including electronic communications, with such directions overriding contrary provisions in wills, trusts, powers of attorney, or terms-of-service agreements.

• Establishes procedures for personal representatives to obtain deceased users' digital assets and electronic communications from custodians upon presentation of death certificate, letters testamentary, and written request within 60 days.

• Grants agents, trustees, and conservators authority to access digital assets of principals, decedents, and protected persons through custodian disclosure procedures with appropriate documentation and court orders when necessary.

• Provides custodians with immunity from liability for good faith compliance and exempts employer-provided digital assets used in ordinary business from the Act's requirements.
