CSSB 193(HSS) - Medical Assistance Work Requirement

• Department of Health and Social Services must apply for a Section 1115 federal waiver to establish work requirements for medical assistance recipients.

• Recipients subject to the requirement must demonstrate participation in work activities for a minimum of 20 hours per week by providing proof of employment, active job seeking, educational/training programs, volunteering, subsistence activities, or caregiving.

• Exemptions from work requirements include individuals under 18 or age 65+, parents/caretakers of children under 12 months or disabled children, pregnant individuals, those unable to work for medical reasons, and those receiving unemployment insurance or participating in tribal work programs.

• Medical assistance coverage must be terminated no less than 90 days after notice for recipients who fail to comply with work requirements, except the requirement cannot prevent access to substance abuse treatment.

• All medical assistance recipients must be notified of the work requirement as soon as practicable upon waiver approval.
