Retail food establishments are prohibited from misrepresenting the identity or origin of seafood or seafood ingredients on menus or in prepared food products.

Employees may report violations anonymously to the department, and establishments are prohibited from retaliating against employees who report violations through dismissal, demotion, suspension, or other adverse employment actions.

Establishments can avoid violation by either verbally warning customers before order placement that substitutions will occur, or by offering a full refund before the misrepresentation is reported to the department.

Violations are classified as misdemeanors punishable by fines of $500 per violation, with a maximum total penalty of $50,000.

"Seafood" is defined to include salmon, halibut, herring, flounder, crab, clam, cod, shrimp, pollock, other finfish and shellfish, and their byproducts.
